Further Draft Exemption Guidance

The Radioactive Substances Act 1993 Amendment (Scotland) Regulations 2011

The Radioactive Substances Exemption (Scotland) Order 2011

The Environmental Permitting (England and Wales) (Amendment) Regulations 2011

Further to my message dated 28 July with drafts of regulatory guidance, I can now send drafts of four further documents as follows:

Uranium and thorium

Museums

NORM contaminated land

Storage in transit

I can also offer more time for comments on the previous drafts than I was able to before. Please can people comment on these and the previous ones by 31 August using the details below.

The above Regulations are in place in Scotland, in Parliament for England and Wales and similar ones are proposed for Northern Ireland. They effectively replace the old definitions of radioactive material and waste in RSA93 and EPR2010 and the old exemption orders under that legislation.

They are available at:

 http://www.legislation.gov.uk/ssi/2011/147/schedule/3/made

 http://www.legislation.gov.uk/ssi/2011/207/contents/made

 http://www.legislation.gov.uk/ukdsi/2011/9780111512319/contents

They come into force or are expected to come into force on 1st October 2011.

The Government is issuing guidance to the regulators and users of radioactive substances and the regulators are producing guidance on implementation. The regulators' guidance will be in a number of sections aimed at specific user groups. The first ones to be available in draft are as follows:

General regulatory guidance

NORM

VLLW

Lamps

Smoke detectors

Medical and veterinary uses

Sealed source disposal

Small open source use and disposal

Small sealed source use and disposal

We are sending copies of the drafts of these to SRP, SULG, CEWG, AURPO, SNNILG, NILG for information and comment of you and your members and I would be grateful if you could distribute as you see fit. Please can comments be sent to: This e-mail address is being protected from spambots. The drafts are based on our current understanding of the Regulations which may change as things develop.
